Welcome, and thank you for your interest in Dream Tiny Houses (“Creator,” “we,” or “us”) and our website at mydreamtinyhouse.com, provided through Fourthwall (the “Service”). These Terms of Service are a legally binding contract between you and Creator regarding your use of the Service.
PLEASE READ THE FOLLOWING TERMS CAREFULLY.
BY CLICKING “I ACCEPT,” OR BY OTHERWISE ACCESSING OR USING THE SERVICE, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND, AS A CONDITION TO YOUR USE OF THE SERVICE, YOU AGREE TO BE BOUND BY, THE FOLLOWING TERMS AND CONDITIONS. IF YOU ARE NOT ELIGIBLE, OR DO NOT AGREE TO THE TERMS, THEN YOU DO NOT HAVE OUR PERMISSION TO USE THE SERVICE.
1. Service Overview
We offer a website where you can purchase merchandise that we make available for sale, including Digital Products (Architectural Blueprints, CAD files, Materials Lists) and Physical Products (Apparel, Mugs, Home Goods) (collectively, "Products").
2. Accounts and Registration
To access certain features or download previous digital purchases, you may be required to register for an account. You agree that the information you provide to us is accurate and that you will keep it accurate and up-to-date at all times. You are solely responsible for maintaining the confidentiality of your account and password.
3. Purchases and Payment
Pricing: Creator reserves the right to determine pricing for all Products. All fees are in U.S. Dollars. We may change fees for any Product, including additional fees or charges. We encourage you to check our website periodically for current pricing information.
Authorization: You authorize the Creator and its third-party payment processors to charge all sums for the Products you purchase, including all applicable taxes, to the payment method specified in your account.
4. Returns and Refunds
Our refund policy differs depending on the type of product purchased:
- Digital Products (Blueprints/CAD): All sales are final. Due to the immediate access to the intellectual property, we cannot offer refunds once the download link has been generated.
- Physical Products (Merch): We accept replacements/refunds for manufacturing defects or shipping damage reported within 30 days. We do not accept returns for sizing issues or change of mind.
5. Digital Product Licensing & Usage Rights
When you purchase a Blueprint Set, CAD File, or Materials List from Dream Tiny Houses, you are purchasing a License to Build, not the copyright to the design itself.
- Single-Use License: The purchase grants you a non-exclusive, non-transferable license to use the plans to construct a single residential structure.
- Prohibited Actions: You may NOT resell, sub-license, redistribute, or share the electronic files (PDF or DWG) with third parties, upload them to public websites, or claim the design as your own work.
- Modifications: You are permitted to modify the CAD files to suit your local site conditions. However, the modified design remains subject to these Terms and may not be resold as a new plan.
6. Intellectual Property & Copyright
The Service, including all architectural designs, floor plans, renderings, graphics, and computer code (collectively, “Materials”) provided by the Creator are protected by intellectual property and other laws. All Materials included in the Service are the property of Dream Tiny Houses.
Except as expressly authorized by these Terms, you may not make use of the Materials. Reselling our blueprints or using our renderings for commercial purposes without written consent is a violation of copyright law.
7. Building Codes & Liability Disclaimer
Engineering & Zoning: Our plans are designed to meet general international residential standards. However, because building codes, zoning laws, soil conditions, snow loads, and wind speeds vary by location, we cannot guarantee compliance with your specific local codes.
Your Responsibility: It is the purchaser's responsibility to hire a local engineer or architect to review the plans and ensure they meet the requirements of your specific building department before construction begins. Dream Tiny Houses is not liable for construction errors, on-site adjustments, or failure to meet local code requirements.
8. Prohibited Conduct
BY USING THE SERVICE YOU AGREE NOT TO:
- Use the Service for any illegal purpose or in violation of any local, state, national, or international law;
- Violate, or encourage others to violate, any right of a third party, including by infringing or misappropriating any third party intellectual property right;
- Interfere with security-related features of the Service;
- Perform any fraudulent activity including impersonating any person or entity;
- Sell or otherwise transfer the access granted under these Terms or any Materials.
9. Indemnity
To the fullest extent permitted by law, you are responsible for your use of the Service, and you will defend and indemnify Creator and its officers, directors, employees, and agents from and against every claim brought by a third party arising out of your unauthorized use of the Service, your violation of these Terms, or your violation of any third party right (including copyright violations).
10. Disclaimers; No Warranties
THE SERVICE AND ALL MATERIALS AND CONTENT AVAILABLE THROUGH THE SERVICE ARE PROVIDED “AS IS” AND ON AN “AS AVAILABLE” BASIS. CREATOR DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
